Kommentar

This module examines special rules of English property law relating to land. The first half of the course considers title to land with a focus on (i) the problems of unregistered title and the scheme of registration of title and (ii) acquisition of title by adverse possession. The remainder of the course is devoted to a detailed consideration in turn of the main types of property right, such as those of tenants and the more limited (positive and negative) rights of use or control typically granted to neighbouring landowners. The module aims to foster critical analysis of legal development in this field in its historical and socio-economic context. There will be opportunity in revision sessions to assess understanding by applying the law to problem scenarios.

Literatur

Students should purchase a copy of a property law statute book, such as Meryl Thomas (ed.), Blackstone’s Statutes on Property Law (32nd edn, OUP 2024). Unmarked statute books may be used in written exams for this course and also for other courses concerned with English property law.

Voraussetzungen

This course requires sufficient passive English language skills to follow the lectures. (Supporting written material will be made available on Moodle.) The assessment requires either active ability in reading and writing in English (with the assistance of a dictionary) or confidence in speaking and listening in English, depending on whether the exam candidate chooses to take a written or oral assessment.

Some general knowledge of the framework of English property law (for example, from the course 'Introduction to Property Law') is an advantage, but not essential.

Leistungsnachweis
Students may choose to take either a written or oral assessment for this course.

The written assessment will consist of a two-hour exam. Students will have an additional 15 minutes period for reading the exam paper. Bound printed English-German/German-English dictionaries (or equivalent for other languages) may be used in the assessment, provided they are not law dictionaries and provided they are not annotated or marked.

Students taking the oral assessment will be examined individually and will be required to answer questions across the range of topics chosen by the student in advance. Questions will be designed to further a dialogue with the student. They will combine both open and closed questions and their exact form will depend on the student's level of knowledge and skills of legal analysis to ensure the student realises their maximum potential in the assessment.
 
LLB Intl Legal Studies students only: This course is assessed by means of a written assessment in the form of a take-home exam paper. The paper will be released online in Moodle and your answers must be uploaded to a Moodle submission portal within 48 hours.  Students on the LLB International Legal studies will also have an oral assessment.
 
All assessments will take place after the teaching sessions have finished.
Zielgruppe

This course fulfils the requirement in §16(2) S. 1 Nr 3 ThürJAPO ('Sprachenschein'). It also forms part of the 'International Legal Studies' Certificate programme and may be taken as one of the courses for the Advanced certificate.
