Este curso dará un panorama del derecho internacional desde América Latina. Iniciará con algunos apuntes históricos sobre la importancia del derecho internacional en las guerras de independencia y en la consolidación de las nuevas naciones latinoamericanas, para después abordar el surgimiento y las características fundamentales del sistema interamericano de protección de derechos humanos. Finalmente, se analizará el desarrollo del derecho constitucional común en América Latina (ius constitutionale commune in Latin America – ICCLA), con especial atención a la jurisprudencia de algunas cortes constitucionales nacionales.
This course will provide an overview of international law from the Latin American perspective. It will begin with some historical notes on the role of international law during the independence wars, and the importance of this body of law in consolidating Latin American statehood. It will then study the emergence and major characteristics of the Inter-American Human Rights System. It will conclude with an analysis of the common constitutional law in Latin America project (ius constitutionale commune in Latin America – ICCLA), paying special attention to the recent case law of certain national constitutional courts.
Due to overlapping appointments the session on January 25th has to be cancelled. To substitute for the cancelled session the courses on December 14th, January 4th and January 11th will start at 10:00 am and end at 12:00 pm. |
