What do Donald Trump, Theresa May, and Jaroslaw Kaczynski have in common? They all are deeply involved in the struggle of democracy and the rule of law. While democracy means in some way majority rule, the rule of law binds the majority, often in favor of the protection of minorities. In this class, we are going to study the concepts of democracy and constitutionalism, the institutional functions of the judiciary in democratically constituted systems, and instances where the struggle between politics and law became apparent. To this end, we will look at classics (like Marbury v. Madison, the German Fernsehstreit) and modern instances (Trump's immigration order, the Brexit decision, the fight of the Polish Constitutional tribunal for survival).
A syllabus will be distributed in the first class session.

The seminar consists of a short introductory session in which we will discuss the conduct of the class and meetings on two weekends from Friday to Sunday.
